Terms & Conditions
General
(1) These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at https://azero.homes/ (together or individually “Service”) developed and operated by Smart Magna Ltd.
Azero Homes operates a membership based platform where members are free to list their homes for rental by other members, who are looking for interesting properties to rent in selective locations. Early emphasis is on beautiful Greek locations but also elsewhere.
Azero Homes invites people to become members of the platform and in turn we welcome their friends to join as well. In this way we create a thriving community of connected members.
Members who own properties and who are interested to list them on the platform, pay an annual listing fee only.
There are no commissions and no other charges unless the member would like to take advantage of additional services as these become available.
There is no financial transaction between members taking place on the platform. Owners take back control of marketing their properties and have direct and unrestricted contact with members who are interested to rent their properties.
In short the platform works as a marketing platform only for members to list their homes and attract members
who have already subscribed to the platform and are known.
Members are encouraged to also exchange homes for short stays for work or pleasure.
Members who wish to rent properties from other members have the additional advantage that all properties are vetted by Azero before being accepted for a listing and all owners are known members.
(2) These terms and conditions regulate the use of the platform and include access from mobile websites and any application (“App”) developed by Azero Homes as well as any platforms or applications for mobile devices provided by third parties. These terms and conditions apply exclusively; Azero Homes rejects the application of any alternative terms and conditions imposed by the User.
(3) The usage of the website is only permitted for private use. A commercial usage of Our Website is explicitly prohibited. Our Website is not to be used for false, fraudulent or speculative reservations, neither for reservations to cover future demand. By using Our Website, you confirm to abstain from the following actions and measures without previous written consent by Azero Homes:
– To access our website by using a manual or automated process that exceeds the purpose of personal use or the inclusion of Azero Homes into a search index. The use of automated systems or a software to extract data from Our Website (so called „screen scraping “), is prohibited for non-commercial and commercial purposes.
– To infringe on existing restrictions in robot-exclusion-headers on Our Website or to circumvent measures that restrict or prevent the access to Our Website.
– To use a device, software or program that affects or tries to affect the regular functionality of Our Website, or to carry out an act that inappropriately strains our servers, computer or network.Αρχή φόρμας
-Access to specific sections of our website is limited. Azero Homes reserves the right to restrict access to other parts of Our website, including the entire site, at our discretion. If we grant you a user ID and password to access restricted areas, content, or services, it is crucial that you maintain the confidentiality of your user ID and password. Please inform us promptly in writing if you discover any unauthorized use of your account or password. You are accountable for any activities on Our website resulting from your failure to keep your password confidential, and you may be held responsible for any resulting losses. Unless you have explicit permission from the individual, you must not utilize someone else’s user ID and password to access Our website. We may deactivate your user ID and password at our sole discretion without prior notice or explanation.
Azero Homes reserves the right to end, suspend or limit the access to all or specific components of Our Website at our own discretion without previous announcement and under exclusion of any liability.
Azero Homes services for users
(1) Where a search returns a large number of results, the results displayed shall be limited to a specific amount to guarantee search functionality.
(2) Azero Homes may permit its services to be provided by third parties
Azero Homes is not liable for offers or subsequent booking contracts
(1) Azero Homes is solely the technical services provider, only enabling a search and presentation of members homes. Azero Homes will not publish their own offers on the aforementioned websites, nor does Azero Homes assume any liability for any offers made. Home Owners carries sole responsibility for all and any offers to users and any other websites linked to by Azero Homes, along with any related declarations of intent Azero Homes does not assume any liability for the accuracy or currency of the information Home Owners give to users.
(2) Any contracts or bookings of overnight stays and/or use of holiday Homes exist solely between the Home Owner and the User. Azero Homes is exempt from any contractual regulation, agreement or claim existing between the Home Owner and the User. Bookings shall be governed exclusively by the Home Owners, particularly with regard to cancellation and withdrawal. Home Owners remains the sole point of contact for booking and payment processes, as well as any questions relating to that contract. Azero Homes is not able to provide any information on these matters.
(3) The previous paragraphs (1) and (2) remain effective provided that and if Azero Homes captures bookings or booking inquiries or the associated data and information itself, for the purpose of the transmission of a booking or booking inquiry to the Home Owner (e.g. within the scope of express bookings or inquiry forms).
Prices
Responsibility for ensuring that prices are appropriate and accurate rests with the Home Owner. Azero Homes is not obliged to present prices.
Liability
(1) Azero Homes is not liable for the accuracy, quality, completeness, reliability or credibility of Home Owners created content and/or offers. In particular, Azero Homes does not provide any recommendation or further information regarding the choice of Home Owners and their Homes.
(2) Azero Homes is not liable for any technical disruption where the cause lies outside of Smart Magna Ltd’s field of responsibility or caused by force majeure.
(3) Azero Homes does not guarantee uninterrupted access to data. Azero Homes retains the right to conduct technical maintenance as required for as long as necessary.
(4) Azero Homes is only liable for damages, regardless of legal basis, caused by deliberate intent and gross negligence. There is no liability for simple negligence except in cases of injury to life, body or health and for claims arising under the Product Liability Act.
(5) Limitations to Azero Homes’ liability also apply to the personal liability of all employees, representatives and agents.
(6) Azero Homes shall not be held liable for any losses resulting from events beyond our reasonable control.
(7) Azero Homes shall not be responsible for any business losses you may incur, including but not limited to loss of profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities, or goodwill.
Indemnity
Home Owners and Users agree to indemnify Azero Homes and hold Azero Homes harmless from any losses, damages, costs, liabilities, and expenses (including legal expenses and settlement payments to third parties advised by our legal advisors) arising from any breach of these terms of use by Home Owners and Users or any claim alleging such breach.
Third-party websites and hyperlinks
Azero Homes may contain hyperlinks to third-party websites, which are provided for informational purposes only. We have no control over the content of these third-party websites and assume no responsibility for any loss or damage arising from your use of them.
You may create hyperlinks to our website on your own website without specific permission, as long as:
(a) the hyperlinks and (b) your website
do not contain or link to any materials that would violate these terms of use if published on our website.
User accounts
(1) For House Owners at Azero Homes website, a so-called House Owner account is required. Please follow the respective instructions of Azero Homes in the course of the registration.
(2) For Users at Azero Homes website, a so-called user account is required. Please follow the respective instructions of Azero Homes in the course of the registration.
(3) A House Owners and User account can be set up with the personal e-mail address and mobile number and confirm your email address in the process. Information such as First and Last Name, Spoken Languages, Address, Nationality are also required.
(4) Changes to House Owners and User information can be made in their Profile.
(5) The House Owners and User account can be accessed from any device.
(6) Azero Homes reserves the right to temporarily block House Owners or User accounts, to irrevocably delete them, or to take other necessary measures if the House Owners or User violates applicable laws or these terms of use.
(7) The deletion of House Owners or User account can be caused by an e-mail to [email protected].
Privacy
(1) Azero Homes gives the highest priority to protecting House Owners and User information. For further information please refer to the Azero Homes Privacy Policy.
(2) Personal information is only provided, processed and utilised with the consent of the House Owners and User or where the collection, processing or use of such data is permitted by law.
Changes To Service
We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users.
Trademarks
Azero Homes and our logos are Smart Magna Ltd trademarks, and any unauthorized use may infringe upon our rights.
Other trademarks or service marks on Our website belong to their respective owners, and we do not endorse or have any affiliation with them. We cannot grant any license to exercise such rights, unless explicitly stated otherwise.
Amendments To Terms
We may amend Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically.
Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently, so you are aware of any changes, as they are binding on you.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Service.
Final conditions
(1) The laws of Greece apply.
(2) Should one of these General Terms and Conditions become invalid in whole or in part, or unworkable under law, this does not affect the validity of the remainder of the contract.

Azero Homes does not participate in, or is obliged to participate in, an online dispute resolution before a consumer dispute resolution institution.
